CaminoByTheWay is committed to giving you the best Camino de Santiago experience possible. Please read the following terms carefully in order to understand the conditions upon paying your deposit.

The Irish business entity CaminoByTheWay, located in Clonakilty, CO Cork, Ireland and owner of this website, is responsible for the information set forth therein.

Customer Obligations:

• Once the Customer has completed and submitted the registration form to CaminoByTheWay, only the Customer is responsible for the accuracy of the data provided during the registration, CaminoByTheWay is not responsible for any consequences arising from the introduction of false or incorrect data by the Customer.

• In case of cancellation by the Customer, the cancellation fees to CaminoByTheWay are listed below, unless the cancellation takes place due to force majeure:

• Cancellation made more than 60 days before starting the tour: 10% of the tour price.
• Cancellation made 45 to 60 days before the commencement of the tour: 20% of the tour price (Reserve).
• Cancellation made 45 days or less before tour start date: 100% of tour price. No amount is refundable.

• Any cancellation of our tours that have already been reserved, must be communicated in writing by the party who has cancelled and will be subject to the following conditions you must be aware of, understand and accept.

• The absence or lack of assistance from any participant in the tour, without prior written cancellation, carries the total loss of the amount paid until that date.

• Only the customer is responsible of managing the documentation required for the journey, as, passport, visas, airport taxes, consular procedures and in general any legal requirement issued through consulates, embassies and public or private entities.

CaminoByTheWay, does not arrange air tickets, and therefore will be not responsible, for any possible problems derived from it acquisition, as, change of flight schedules, flight cancellations, airport or transport strikes etc.

• The customer understands that he/she is taking part in an activity with physical demands and is medically, physically and emotionally fit to participate and that this is an outdoor activity that includes walking in open paths, along roads and open terrain, among hills, in variable weather conditions, in rural or remote areas and accepts all the inherent dangers that come along with this kind of activity.

• The customer agrees to release CaminoByTheWay, its directors, employees, agents, representatives, collaborators, and independent contractors (all denominated ‘Agents’) from and against all claims, actions, causes of action, costs, expenses and demands of any nature or kind whatsoever in respect to death, injury, loss or damage to him/her, wheresoever and howsoever caused arising out of, or in connection with my taking part in the Activity provided by CaminoByTheWay. or while traveling to and from the activity notwithstanding that the same may have been contributed to or occasioned by any act including, without limitation, negligence of CaminoByTheWay and/or any one or more of it’s ‘agents’.

• The customer understands that any time CaminoByTheWay reserves the right to accept or decline continued participation to any persons, if in the judgment of the tour leader / guide said person’s behavior is causing unreasonable disturbance or hazard to themselves, any other participants, or to CaminoByTheWay.

• The customer understands that during the tour, he/she may be photographed and agrees to allow photos, videos, or films to be used for any legitimate purpose by CaminoByTheWay or to be posted online on Facebook or on our webpage.

• This contract shall be governed by Irish law and all matters arising there from are subject to the exclusive jurisdiction of the Irish Courts.

Obligations of the company: 

• Once the registration form and payment of the reservation made by the Customer is verified, CaminoByTheWay will send a written payment note via e-mail, stating the specifications for the tour booked.

• In the event that CaminoByTheWay is obliged to cancel any of its programs for reasons not attributable to the customer and not attributable to force majeure, the company will compensate the customer with all the amounts that would have paid for the Program until that moment.

• Once the tour begins, the Customer may only withdraw from the tour certifying reasons of serious injury or illness. In that case the company will refund to the customer the proportional amount corresponding to the days not enjoyed. These returns are calculated on the total amount paid, but does not include the 20% paid at time of booking, which corresponds to fixed charges and the cost grant already made by the company. Other costs incurred might not be refundable.

• CaminoByTheWay has no obligation to indemnify or return any amount of money to their customers on the following assumptions:

When the reasons for failure in the execution of the contract are attributable to the Customer.

When the impossibility of compliance with the conditions agreed on the tour are attributable to a third party and are unpredictable and insurmountable.

When the trip is canceled, due to force majeure, meaning such conditions beyond those who invoke them, unusual and unforeseeable consequences would have been unavoidable, despite having acted with due diligence: For reasons of force majeure accredited and when the problem can not be foreseen or forestalled.
